"My ex-husband has a girlfriend and now I have found out that she is pregnant by him. How does this affect the maintenance that my ex-husband pays me for our two children according to the divorce law introduced three years ago?"

 

It is  assumed that the maintenance contribution which your ex-husband pays for your mutual  children will be lower because of  the birth of his new child. The principle applies that all children of one parent are to be treated equally, which is why the new-born child has the same claim to maintenance from the father as the other children. Furthermore, since the circumstances will change considerably and permanently due to the birth of the new child, this may lead to an action for modification so that the maintenance contribution can be adjusted. Your ex-husband must initiate this action for modification at the court of law competent for the judicial district where he resides.  Until then or until the that court has decided on this, the maintenance contributions are paid  according to your divorce convention.
